If you place an order electronically through the website you are currently using, you are deemed to have accepted the pre-information form and distance sales agreement provided to you. Buyers are subject to the provisions of the Law on the Protection of Consumers No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchased. Shipping costs for products with shipping charges will be paid by the buyers. Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer, within the legal period of 45 days, provided that it does not exceed. If the product is not delivered within this period, Buyers may terminate the contract. The purchased product must be delivered complete and in accordance with the specifications specified in the order, along with any warranty certificates, user manuals, and other documents, if any. In case it becomes impossible to sell the purchased product, the seller must notify the buyer of this situation in writing within 3 days from the date of learning about it. The total price must be refunded to the Buyer within 14 days.

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

If the buyer does not pay the price of the purchased product or cancels it in the bank records, the seller’s obligation to deliver the product ceases.

SHOPPING MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

If it is determined that the payment made with the buyer’s credit card, which has been delivered the product, has been fraudulently used by unauthorized persons and the sold product price is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the contractual product to the SELLER within 3 days, with the shipping cost borne by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

If unforeseeable force majeure reasons occur for the Seller and the product cannot be delivered on time, the situation will be notified to the Buyer. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is eliminated. If the Buyer cancels the order; if payment was made in cash, the price will be refunded in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels, the product price will be refunded to the bank within 14 days from the cancellation, but it may take 2-3 weeks for the bank to transfer it to the Buyer’s account.

BUYER’S OBLIGATION TO INSPECT THE PRODUCT:

The Buyer must inspect the goods/services subject to the contract before taking delivery; damaged, broken, torn packaging, etc. damaged and defective goods/services will not be accepted from the shipping company. DURATION OF WITHDRAWAL RIGHT:

If the item purchased is a service, the 14-day period for the right of withdrawal starts from the date of signing the contract. In service contracts where the service has started with the consumer’s approval before the expiration of the withdrawal period, the right of withdrawal cannot be used. The expenses arising from the use of the right of withdrawal shall be borne by the SELLER. In order to exercise the right of withdrawal, it is required to notify the SELLER in writing by registered mail, fax or email within 14 (fourteen) days and the product must not have been used within the framework of the provisions on “Products for which the Right of Withdrawal cannot be used” stipulated in this agreement.

EXERCISE OF WITHDRAWAL RIGHT:

RETURN CONDITIONS:

The SELLER is obligated to refund the total price and return any documents that bind the BUYER within a maximum of 10 days from the receipt of the withdrawal notification. The SELLER is also responsible for receiving the returned product within 20 days.

If there is a decrease in the value of the product due to a reason arising from the fault of the BUYER or if returning the product becomes impossible, the BUYER is liable to compensate the SELLER for the damages in proportion to their fault. However, the BUYER is not responsible for any changes or damages that occur in the product or item due to its proper use during the exercise of the right of withdrawal.

If the use of the right of withdrawal results in the total purchase amount falling below the limit set for a promotional campaign, the discount amount obtained through the campaign will be canceled.

PRODUCTS THAT CANNOT BE RETURNED UNDER RIGHT OF WITHDRAWAL:

1. Products that are prepared according to the BUYER’s explicit personal needs or that are not suitable for return due to their nature, such as underwear bottoms, swimwear bottoms, makeup products, disposable products, perishable goods, or products with a risk of expiration after delivery.
2. Products that are not suitable for return from a health and hygiene perspective, such as products whose packaging has been opened by the BUYER, mixed with other products, or cannot be separated due to their nature.
3. Goods related to periodic publications such as newspapers and magazines, except for those provided under a subscription agreement.
4. Non-material goods that are delivered instantly in electronic form or provided to the consumer immediately, such as audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, whose return is not possible according to the regulations if their packaging has been opened by the BUYER.
5. Services that have started with the consumer’s approval before the expiration of the withdrawal period, as well as services that are not eligible for withdrawal according to the regulations.
6. Cosmetic and personal care products, underwear products, swimwear (bikini, swimsuit) products, books, reproducible software and programs, DVDs, VCDs, CDs, and stationery consumables (toner, cartridge, ribbon, etc.) must have unopened, untested, undamaged, and unused packaging in order to be eligible for return.

DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults on payment when making payments with a credit card, the BUYER acknowledges, declares, and undertakes to pay interest and be liable to the bank within the framework of the credit card agreement with the cardholder bank. In this case, the bank may take legal action, request expenses and attorney fees from the BUYER, and in any case, the BUYER agrees to compensate the damages incurred by the SELLER due to the delayed performance of the debt as a result of defaulting on the debt.
